Terms
Terms of Use
Effective 13 July 2026. These Terms govern access to and use of campaignspark.pro and related digital properties operated by CampaignSpark Inc.
1. Agreement to these Terms
By accessing or using this website, you agree to these Terms of Use and to our Privacy Policy and Cookie Policy. If you do not agree, do not use the site. If you are using the site on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms where applicable.
These Terms apply to website visitors and enquirers. Paid marketing services are governed by separate statements of work, master services agreements, insertion orders or proposals issued by CampaignSpark Inc. In the event of a conflict between these website Terms and a signed services contract, the signed contract controls for the services relationship.
2. Who we are
The website is operated by CampaignSpark Inc., Business Number 851947263ON0001, with a studio at 100 Ouellette Avenue, Suite 1100, Windsor, ON N9A 6T3, Canada. Contact: [email protected] and +1 (226) 555-8173. CampaignSpark is a performance marketing agency. We are not an AI product vendor, SaaS platform, IT managed services firm or general web development studio.
3. Permitted use
You may browse the site for lawful informational purposes, submit enquiries through provided forms, and download materials we expressly make available for download. You must not attempt to gain unauthorised access to our systems, interfere with site operation, scrape content at a volume that degrades service, introduce malware, misuse forms for spam, impersonate others, or use the site to violate applicable law.
We may suspend or block access where we reasonably believe misuse has occurred. We may also rate-limit automated requests to protect infrastructure hosted in Canada / North America.
4. Intellectual property
Unless otherwise noted, the website design, text, graphics, logos, icons and compilation are owned by or licensed to CampaignSpark Inc. and are protected by Canadian and international intellectual property laws. You may not copy, modify, distribute or create derivative works from site content for commercial purposes without prior written consent, except for fair dealing or other exceptions under applicable law.
“CampaignSpark” and related branding are used to identify our agency. Third-party marks appearing on the site are the property of their respective owners and do not imply endorsement except where expressly stated.
5. Programme descriptions and pricing
Programme names, descriptions and starting prices in Canadian dollars are indicative and may change. Published starting fees do not include media spend, stock licensing, specialised production, platform fees or taxes unless expressly stated. A formal proposal or statement of work is required before paid services begin. Nothing on this website constitutes an offer capable of acceptance without our countersignature or written confirmation.
6. No guarantees of results
Marketing outcomes depend on many factors outside our exclusive control, including competition, auction pricing, creative performance, website conversion quality, sales follow-up, seasonality and macroeconomic conditions. We do not guarantee return on investment, search rankings, lead volumes, revenue or any specific business result. Case studies or metrics referenced on the site are illustrative and not warranties of future performance.
7. User submissions
If you submit information through our contact forms or email, you represent that the information is accurate to the best of your knowledge and that you have the right to provide it. You grant us permission to use submission content to respond to you and, where you become a client, as needed to deliver services. Do not submit confidential third-party information through public forms unless necessary and authorised. Honeypot fields must be left blank by human users.
8. Third-party services and links
The site may reference or link to third-party websites, advertising platforms or tools. We are not responsible for their content, availability or practices. Your use of third-party services is subject to their terms. When we later manage platforms on a client’s behalf, platform terms and policies also apply to that operational relationship.
9. Disclaimers
The website is provided on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, CampaignSpark Inc. disclaims warranties of merchantability, fitness for a particular purpose and non-infringement regarding the website. We do not warrant that the site will be uninterrupted, error-free or free of harmful components, though we take reasonable steps to maintain availability and security.
10. Limitation of liability
To the fullest extent permitted by applicable law, CampaignSpark Inc. and its directors, officers, employees and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or business opportunity, arising out of or related to your use of the website, even if advised of the possibility of such damages. Our aggregate liability arising out of website use shall not exceed one hundred Canadian dollars (C$100) or the minimum amount permitted by law if a higher minimum is mandatory.
Some jurisdictions do not allow certain limitations. In those jurisdictions, liability is limited to the maximum extent permitted. Nothing in these Terms excludes liability that cannot be excluded under Ontario or applicable Canadian law.
11. Indemnity
You agree to indemnify and hold harmless CampaignSpark Inc. from claims, damages, losses and expenses (including reasonable legal fees) arising from your misuse of the website, your violation of these Terms, or your infringement of third-party rights in connection with materials you submit.
12. Privacy and cookies
Personal information is handled as described in our Privacy Policy. Cookie technologies are described in our Cookie Policy. Form consent for PIPEDA-related processing must be actively provided and is not pre-selected.
13. Governing law and disputes
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles that would require application of another jurisdiction’s laws. Courts located in Ontario shall have exclusive jurisdiction over disputes arising from website use, subject to any mandatory consumer protections that cannot be waived.
14. Changes
We may revise these Terms by posting an updated version with a new effective date. Continued use of the site after changes constitutes acceptance of the revised Terms for subsequent visits. For material changes, we may also provide additional notice where appropriate.
15. Severability and entire agreement
If any provision of these Terms is held unenforceable, the remaining provisions remain in effect. These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement regarding website use and supersede prior website terms, without affecting separate services contracts.
